The Control of Asbestos Regulations 2006 introduced an explicit duty to manage asbestos in non domestic premises. The duty requires those in control to take steps to determine the location and condition of materials likely to contain asbestos (ACMs) and to draw up a management plan. Failure to comply is a criminal offence with a maximum penalty of an unlimited fine.
